Terms and Conditions

1. Conditions

These Conditions shall form the basis of the contract between the Seller and the Buyer in relation to the sale of Goods, to the exclusion of all other terms and conditions including the Buyer’s standard conditions of purchase or any other conditions which the Buyer may purport to apply under any purchase order or confirmation of order or any other document.

All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods from the Seller pursuant to these Conditions.  

Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of the Buyer’s acceptance of these Conditions.

These Conditions may not be varied except by the written agreement of the Seller.

These Conditions represent the whole of the agreement between the Seller and the Buyer.  They supersede any other conditions previously issued.

 2. Price

The Price shall be the price quoted within the product description.  The Price is inclusive of VAT. 

The RRP price of a product is the price which the manufacturer recommends the retailer sell the product for. RRP prices have no connection to "was prices" or "after sale prices".

 3. Payment and Interest

Payment of the Price and VAT must be paid at sale, prior to delivery arrangements being made.   

The Buyer must pay in full at sale and not exercise any rights of set-off or counter-claim against invoices submitted by the Seller.

We accept payment by Credit and Debit card. We regret that we do not accept payment by American Express.

 4. Goods

 The quantity and description of the Goods shall be as set out in the Seller’s confirmation of order.

5. Carriage of Goods

Carriage is free of charge to the Buyer to UK Mainland address only, charges will be applied to orders where delivery is required to an address on any off shore island and Northern Ireland. We reserve the right to change this term at any time. 

6. Ownership of the Goods

You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. 

7. Delivery

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate.

We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).

We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed.

If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to confirm the new delivery date.

Failed deliveries may result in the Buyer incurring charges. Our courier (Yodel) will make 2 delivery attempts to a residential address and one delivery attempt to a business address, after this the item will be returned to us, to arrange a re-delivery back to the customer which will be charged at our current rate set at the time.

Delivery is free of charge to UK Mainland address only, please see our shipping page for other areas including northern ireland and offshore islands.

Delivery is made on a working day – Monday to Friday, therefore not including weekends or Bank Holidays. 

All orders received before 4pm on a weekday will be despatched the same day for delivery the following working day. All orders received after 4pm on a weekday will be despatched the following working day for delivery to the customer the working day after that. All orders received over the weekend will be despatched the first Monday thereafter for delivery on the Tuesday (except bank holidays - which will be despatched on the next working day).

We are unable to advise what time your order will be delivered. Delivery is an all day appointment and a responsible person should be at the property to accept the delivery. 

8. Warranty

We do not accept liability or offer any warranty for any product used in a commercial environment.

9. Right to Cancel

We fully comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Any orders placed which are made to order OR reserved at your request, will be subject to a 25% cancellation fee.

We understand customers change their mind from time to time once they hae received their product, in situations like this please notify us via email within 48 hours of receiving your goods and we will arrange for our courier to come and collect the items from you. Please note in situations like this all collections will be charged at cost which is no more than £10 per bar stool.

You are required to contact us first via email to confirm your intentions to return the item/s to us. Once your returns request has been approved we will then advise you accordingly. Upon receipt of the goods they will then be fully inspected and any refunds due will then be processed within a 14 day period. Please note we will not accept the return of any product that has been assembled, used or not within it's original packaging. 

We reserve the right to cancel the Agreement between us if we have insufficient stock to deliver the goods you have ordered, we do not deliver to your area or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

We do not guarantee colour matches under any circumstances as products from different batches can vary in colour. Our suppliers may change their specifications during manufacture. Cancellations will not be agreed on these grounds.

If you wish to cancel your order, we require this to be confirmed to us by email.

The photographs on our website are our photographs and are protected by copyright. The photographs are of our products but are for illustration purposes only, and we cannot guarantee the colour or shade will be as your particular computer screen displays, as the colour varient can vary considerably. The photographs are there as a guidance only. Cancellations will not be agreed on these grounds.

9.1 Problems with Product

Any damage or problems with your products must be reported to us within a 48 hour period, so we can resolve your issue for you. We deem this as a reasonable period of time to have fully checked the goods in all cases. As with the above, all items received must be re-packaged in the original packaging they were first sent out in.

If you are unhappy with any aspect of our service, please contact us via the ‘Contact Us’ link on our website. Any complaints will be dealt with sympathetically and we will work with you to reach a satisfactory conclusion.

11. Liability

After accepting the goods at delivery, we are not liable for any personal injury caused through use of the product.

12Governing Law and Jurisdiction

Parties to this Agreement agree to submit to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms and Conditions of Business

We reserve the right to make minor changes to this Agreement from time to time. Any major changes will only be made with your agreement.

14. Third Party Rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

15. Entire Agreement

This Agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written.

 16. Data Protection

You consent to the computer storage and processing of your personal data by us in connection with this Agreement and to the transmission of this data across the company and its business partners for the purposes of our legitimate interests including statistical analysis, marketing of our services and credit control. If you breach this Agreement, your personal data may be disclosed or passed to third parties to the extent necessary to assist recovery procedures.

 17. Guarantee

We reserve the right to refuse to guarantee any product which is part of an order where the funds have been subject to a chargeback claim by the buyer. Any order where a chargeback has been filed will render its guarantee null and void for all items purchased within the said order.

Please note that all items purchased come with a 1 year guarantee as standard. This guarantee is for the structure of the item only, and does not cover any cosmetic damage or general wear and tear to the product itself.The structure includes the entire gas lift mechanism and operating lever, as well as the seems and the stitching. Cracks and splits to acrylic or plastic bar stools will not be covered, along with splits and tears to leather and faux leather bar stools, unless they are of a structural nature, i.e the seams and the stitching. This does not affect your statutory rights.

18. Privacy Policy

We do not store credit card details nor do we share customer details with any 3rd parties. We do not send random marketing emails to personal email addresses.
